Terms of Service
The plain version: I build automation systems for your business. You pay me. If either of us isn't happy, we can walk away. Here are the details.
Who this is between
These terms are between you (the business owner using my services) and me, Diego Valdes, doing business as Valdes Systems out of Saint Marys, Georgia.
What I provide
I build and maintain automation systems for home-service and trades businesses. The exact services and pricing depend on what we agree to on our call — whether that's missed-call text-back, lead follow-up, review automation, a website, or any combination from my pricing page.
How payment works
- A one-time setup fee is due before I start building
- Monthly retainers are billed on the same day each month after that
- All payments go through Stripe (industry-standard secure payment processor)
- If a payment fails, I'll reach out before pausing anything — I'd rather solve the problem than cut you off
Cancellation
- No long-term contracts. Month-to-month.
- Cancel anytime with 7 days notice (so I can shut things down cleanly)
- You keep your phone number, your customer history, and any data the system collected for your business
- No termination fees
- Setup fees are non-refundable once the build is complete, but if I haven't started yet, you get it back
What I'm responsible for
- Building the system correctly per what we agreed on the call
- Keeping it running (uptime, fixes, updates)
- Responding to your questions within 1 business day (usually same day)
- Being honest about what the system can and can't do for your business
What I'm NOT responsible for
- Outages caused by your phone carrier or third-party tools beyond my control
- Lost revenue if the system fails to catch a call (I make every effort to keep it up, but no system has 100% uptime)
- Anything you do with the system that breaks the law (telemarketing laws, TCPA, etc — you're responsible for your own compliance)
Liability
If something goes wrong because of me, my maximum liability is whatever you've paid me in the last 3 months. That's standard for service businesses and protects us both from outsized claims over relatively small engagements.
Governing law
These terms are governed by the laws of the State of Georgia. If we ever can't work something out, we'll handle it in a Georgia court — but I'd much rather just talk it through and figure it out together.
Changes to these terms
If I update these terms, I'll email you 30 days before the change takes effect. If you don't agree, you can cancel without penalty.
